Foreign companies taking on projects in Norway must handle a clear set of tax rules, and permanent establishment status plays a central role. While Norway may only tax business profits that are linked to a permanent establishment, this status can arise earlier than many companies expect.

The classical and most obvious case would be that a foreign company has a “fixed place of business” in Norway, e.g. office premises. Anther case can be a foreign company that employs an “agent” in Norway, who enters into agreements with Norwegian customers on behalf of the foreign firm. Things become even more complicated in cases where the foreign company participates in a construction, installation or assembly project that lasts for more than six or twelve months – even if the actual work on site is performed by a subcontractor.

Understanding where the thresholds lie is key to avoiding unexpected liabilities.
